The opinion of the court was delivered by This is a direct appeal by the defendant, Kurt Donnell Wesson,
from his convictions of felony murder (K.S.A. 1989 Supp. 21-3401)
and of attempted sale of crack cocaine (K.S.A. 1989 Supp.
65-4127a). Wesson contends that the sale, or attempted sale, of crack
cocaine cannot be the underlying felony to support a charge of
felony murder; that numerous errors were made concerning
evidence; and that there was insufficient evidence to support a
guilty verdict for attempted sale of crack cocaine and for
premeditated murder. Other minor issues will be disposed of in
the opinion.
