Appellant was convicted of burglary in the first degree and sentenced to a term of five to six years in the state prison. On appeal he contends that he was denied his right to a speedy trial and that his constitutional rights were violated at his jury trial by the testimony of a witness for the State who commented on appellants failure to testify on his own behalf. We are unable to sustain either contention and the judgment of conviction and sentence is affirmed.
