Monroe Weso, Jr., the appellant, was charged with causing great bodily harm to another human being by conduct imminently dangerous to another and evincing a depraved mind regardless of human life (sec. 940.23, Stats.). A jury trial having been waived, Weso was tried to the court which found him guilty, not of causing great bodily harm in violation of sec. 940.23 but of endangering anothers safety by conduct imminently dangerous to another and evincing a depraved mind regardless of human life (sec. 941.30). The trial court sentenced Weso to an indeterminate term of not to exceed three years in the state reformatory -- the sentence to run concurrently with the one he was then serving on a burglary conviction. From the judgment of conviction, Weso appeals.
