His motion for new trial was overruled, he was sentenced to confinement pursuant to K.S.A. 1971 Supp. 21-4501 (b) and he now appeals. Jerome L. Gronquist, aged nineteen, was the victim of the alleged homicide which occurred near Waterville, Kansas, during the early morning hours of November 22, 1970.
