On March 19, 2001, Vancouver Police Officer William Russell observed Strong and one other man chasing Wenholz near a Burgerville restaurant in Battleground. When Officer Russell questioned Strong as to why he was pursuing Wenholz, Strong said that Wenholz had stolen a $20 bill out of his hand. Michael Roland, an acquaintance of Strongs, testified that he saw Wenholz run by and grab the bill out of Strongs hand. Officer Russell pursued Wenholz, identified himself as a police officer and told Wenholz to stop, which Wenholz did. Wenholz did not have a $20 bill on his person, nor was one found nearby.
